A Harrisburg, Pennsylvania mother has been arrested and charged with murder in the death of her young son, who drowned in the bathtub while his drunk mom was not paying attention.
Kathryn Jacoby, 25, called 9-1-1 on August 31 to tell them that her child had fallen in the bathtub and become unresponsive. The 1-year-old boy was pronounced dead at the hospital and it was determined the cause of death was drowning. Jacoby changed her story several times, but finally told authorities that she had left the her son as well as her 2-year-old daughter alone in the bathtub in the upstairs bathroom while she was downstairs talking on the phone. They had been left in the tub without supervision for at least 22 minutes, possibly longer. Jacoby’s daughter was not harmed.

But perhaps most damning was the fact that Jacoby had been drinking and smoking marijuana. And not just a bit: Jacoby’s BAC was .15 percent, which is nearly twice the legal limit to drive. This is why, according to Chief Deputy D.A. Sean McCormack, criminal charges have been filed.
“I think the saddest thing, if there is a lesson to be learned from this whole thing, is the fact that you can’t under any circumstances leave a child alone in the bathtub, especially a baby that’s 12 months old,” he said. It’s just too dangerous of a situation.”
